The general conditions described below, regulate the contractual relations between “Movilidad Ampliada S.L.” with CIF B-86933322 and domiciled in Madrid, Avenida de Menéndez Pelayo 25, 2ºB. 28009 Madrid. Registered in the Registro Mercantil de Madrid, in Volume: 32.051, Folio: 1, Section 8, Sheet: M-576777, Inscription 1, and the “Client” of the service, in everything related to the provision of services related to rental and sale of mobility and accessible tourism products.

The acceptance, without reservation, of these General Conditions is essential for the provision of the Service by Movilidad Ampliada S.L. The client declares that he has read, understood and accepted these General Conditions, made available at all times, prior to contracting, on the following website: https:// www.wateamobility.com

The use of the service also entails the acceptance by the client of any notices, regulations of use and instructions made known to him by Movilidad Ampliada S.L. after the acceptance of these General Conditions.

Guarantee

The warranty period is, by default, three years -except for batteries in electrical products, which is 6 months-. After 6 months it will be the customer’s responsibility to prove that the defect in the product was of origin. The guarantee does not include deficiencies caused by negligence, blows, incorrect use or improper handling, incorrect installations, etc., nor materials that are worn by use. During the warranty period, MOVILIDAD AMPLIADA, SL reserves the right to request verification of the origin of the problem from an official technical service of the brand. In the event of a defect caused by misuse, the repair will be billable. In those incidents that justify the use of the guarantee, the repair, replacement of the article, discount or return will be chosen, in the legally established terms. www.wateamobility.com will make changes or returns provided that:

a) Previously communicate to our Customer Service: This step is essential whatever the reason for the return. You must do so in writing by email to info@wateamobility.com. MOVILIDAD AMPLIADA SL will communicate the steps to follow when returning the item.

b) The item must be properly packed and as it was delivered to the customer for return.

c) After verification, and if the above conditions are met, MOBILIDAD AMPLIADA SL, will proceed, as agreed with the client, to repair, replace, reduce the price or terminate the contract, procedures that will be free for the consumer and user. . www.wateamobility.com is responsible for any lack of conformity that manifests itself within a period of two years from delivery. In second-hand products, the seller stipulates a maximum period of 6 months from delivery. The consumer or user must inform the seller of the lack of conformity within two months of becoming aware of it.

Withdrawal and return of products

The products offered at www.wateamobility.com admit the right of withdrawal. The product will be returned in perfect condition (beyond verification by the customer that the product has been delivered in perfect working order and use). In case of carrying accessories, cables… and they were not returned, or if it is not sent in the same original packaging, the product may suffer a demerit. The deadline to withdraw is 14 calendar days from receipt of the order. The return shipping costs will always be borne by THE CUSTOMER. Once the merchandise is received in our warehouses, and after checking its status, the amount will be refunded, together with shipping costs, if any, in the terms established in RDL 1/2007, in accordance with the method of payment made by the client, except cash payment, which will be refunded by bank transfer.

The return guarantee will be excluded:

For hygienic reasons, toiletries, mattresses, hygiene, pillows, cushions and other anti-decubitus products, if these have been removed from their original packaging or open their seal if it was carried.

If the product, once delivered, suffers deterioration caused by external events, accidents or failure to comply with the instructions for use.

If the product is damaged by the wrong assembly, use, installation or configuration of the accessories by the client.

If a breakdown occurs caused by a component not supplied by our company.

If it is a product made to measure, personalized or modified at the request of the client.

If the product is not in perfect condition.

If the packaging has not been properly protected to be received in perfect condition.

Purchase procedure

Once you have decided which product you want to purchase, it must be selected and added to the cart by clicking on the corresponding icon.

  1. A) PRODUCT CHOICE: the Customer must select the desired Article by clicking on its icon, and then see the image, description. Once the desired Item has been chosen, the Customer must click on the “buy now” link.
  2. B) MY BASKET: Once the selection is finished, the customer can follow the purchase process or can select a new product by returning to the sales section. Once the Customer has selected all the Items he wishes to purchase, he must check that the data of the same that appear in the basket are correct. Also, the basket will show the price of each Item (including taxes) and the total purchase price. The order must be confirmed by clicking “Pay” to then choose the payment method.
  3. C) PAYMENT METHOD: To select the payment method, the application will ask the Customer to select the desired payment method. For the option of payment by transfer, all expenses derived from said operation will be borne by the Client. In order to be able to make the payment through this option, the following current account number opened in the entity, “SANTANDER”, is provided in the name of MOVILIDAD AMPLIADA S.L.:

  1. D) CONFIRM: Once the payment method has been selected, and before sending the order, the Customer will be able to view a summary of the shipping data, the payment method and his order. The order must be confirmed by clicking on the “Continue to the next step” link. The confirmation of receipt of the order will be communicated via email

Payment method and taxes

With the aim of collaborating in the prevention of fraud through the Internet , wateamobility.com reserves the right to verify the personal data provided by the customer and adopt the measures it deems appropriate (including the cancellation of the order) so that the purchased goods are delivered in accordance with the data contained in the order.

All prices on this website are shown in Euros and include indirect taxes. In accordance with current legislation, wateamobility.com is obliged to charge VAT on all orders. The applicable VAT is the legally applicable rate. Once the purchase order has been completed, and before making the payment of the order, a final summary will be presented identifying the item / s purchased and its total price (taxes included).

Transport

The delivery time is usually 48/72h on working days and does not commit to its exact fulfillment, as it is a service provided by third parties outside wateamobility.com. Deliveries will be made within the delivery schedule of the transport company. If additional mechanical means have to be used for the delivery of the goods, the costs will be borne by the customer. To avoid incidents in the delivery, it is essential to correctly complete the corresponding form being advisable to fill in the box related to the contact telephone number. In case of failure in delivery, due to any error or inaccuracy in the transmission of data by the customer (wrong addresses, inability to find someone at home, etc.), the transport costs will be borne entirely by the customer. As for the coverage of the shipment, the purchase of the products offered is valid exclusively in the territory of the Spanish state, except for the Canary Islands, Ceuta and Melilla and the rest of the world. Shipments to these excepted territories will be made by prior quotation request.

Individuals residing outside Spain can only benefit from the online purchase service of this website when the shipping address of the order is within the aforementioned territory. Within the Spanish territory, shipments of inter-island products, from peninsula to islands or vice versa and shipments outside Spain are not contemplated. The company is not responsible for delays in cases of force majeure, such as the interruption of activity or total or partial strike of postal services and means of transport or communications, floods or fire.

Estimated delivery time of the order

It depends on the product and if we have stock, but normally orders are delivered between 2 and 3 working days. If the delay is more than one week, you could opt for a full refund of the product.

Shipping costs

The price of the product includes transportation to your home, except for those products with an end user price of less than 200 EUR (which will have a minimum shipping price of 12 EUR) and those that must be sent to the Spanish islands or outside of Spain ( They will be quoted based on the volume of the product and the shipping area). It will not be possible to send orders to military bases or post office boxes. Shipping costs may be modified at any time without prior notice. In any case, those shipping costs that appear at the time of placing the order will be valid.

Availability of articles

All orders are subject to item availability. If there are incidents regarding its supply, or if there are no items in stock, the customer will be informed promptly.

Assembly

In the event of purchase of items that require assembly at the point of destination, this will always be borne by the customer (except in the case of those products that may include an extra for assembly).

Cancellation or modification of order

An order can be cancelled or modified at no cost to the buyer, as long as the product has not left the warehouse. Once the shipment is underway, shipping and handling costs will be reduced (which will be borne by the customer)

Applicable law and jurisdiction

The General Conditions are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user’s domicile.
